Diamond Bar Postnuptial Agreements Attorneys

Many couples who want to eliminate potential causes for drawn-out legal disputes after a marriage ends will create a prenuptial agreement. However, circumstances may change during a marriage that may give rise to the need for a legal agreement between couples who did not create an agreement before getting married. In these cases, a postnuptial agreement may be the solution, offering an opportunity for spouses to protect their assets, or even to prevent a spouse from incurring responsibility for debts, in the event of a divorce. If you believe a postnuptial agreement might be right for you, contact our lawyers at Blasser Law for more information.

Why create a postnuptial agreement?

Over the course of a marriage, circumstances can change, leaving spouses wanting additional protection of their assets. For example, one spouse may develop a substance abuse problem which leads to erratic or dangerous behaviors, or that simply makes a divorce appear more likely to occur. A spouse may also inherit or build a business, substantially altering their net worth. In some cases, one spouse may develop problematic spending habits, and the other spouse may need protection against being jointly responsible for that spouse’s debt. Some spouses may only agree to remain in a troubled marriage if the other spouse signs a postnuptial agreement.

What standards must a California postnuptial agreement meet?

Unlike many other types of legal documents, California courts will assume that postnuptial agreements are invalid if challenged in court. Attorneys who wish to enforce a postnuptial agreement must prove that:

  • The agreement was in writing, signed by both parties, and notarized
  • The agreement was signed voluntarily, and neither spouse was deceived, coerced, or threatened to get them to sign the agreement
  • The agreement is fair and does not strongly favor one spouse
  • Both spouses had a complete picture of the other spouse’s assets, income, property, and debts before signing the agreement.

Due to the bias against finding postnuptial agreements valid in California, creating a postnuptial agreement demands the attention of a seasoned and knowledgeable lawyer. The Diamond Bar family law attorneys at Blasser Law have developed the skills necessary to create reliable and effective postnuptial agreements that will protect your rights in a split.
