Preparing for Divorce: Protecting Your Legal Rights, Assets and Emotions

Should I leave or should I stay?  This is undoubtedly one of the toughest decisions a married person can face.  In those difficult moments, the farthest thought from your mind is preparing for a divorce.  But, if you are even contemplating divorce, planning ahead for it is crucial.  In addition to settling your nerves, knowing your rights will protect your assets and the rights of your children.

Procrastination can be common during a troubled marriage…don’t let that happen to you. Speak to a qualified attorney as soon as possible.  Ask as many questions as you possibly can.  Don’t be afraid to tell the attorney that you need some time to think about everything after your initial consultation (which some law firms, such as Blasser Law, will provide at no charge).

Family law issues are close to the heart and may involve your children, future and assets. Accordingly, selecting the right attorney is very important and you should choose someone you trust and are comfortable with.

Before meeting with an attorney for the first time, think about your personal costs of living – consider debts, monthly bills, child-related expenses, tax liabilities, medical expenses and any other out-of-pocket expenses.  These are costs your attorney will need to consider to come up with a solid strategy to deal with your case.  Collect as much documentation as possible to enable your attorney to develop your case with accurate data.  Follow the advice of your attorney, but expect to be (and require that you are) kept in the loop at all stages of the process.

Taking these steps will prepare you for the legal issues you are facing. More importantly, however, they will calm your nerves, remove uncertainty and provide structure to a seemingly turbulent time in your life.  Understanding the divorce process and knowing your rights (and the rights of your dependents) will allow you to set reasonable expectations about the process.  Your emotional and mental well-being should be your most important concern – empower yourself with knowledge and leave the rest up to your attorney.
